DMX Sued Over Failed Comeback Tour

Rapper DMX has only been out of jail for a few months, but it seems he can't escape the law. The hip-hop star is being sued by a booking agency he had allegedly hired to plan his European comeback tour. As fans know, that tour, which was slated to begin March 29 in Germany, has been cancelled.

Booking agency Heavy Rotation has since sued DMX in New York court. The DMX tour lawsuit accuses the artist of souring the deal by failing to stay out of legal trouble.

DMX, 41, allegedly gave Heavy Rotation the worldwide exclusive right to book his concerts, reports gossip website TMZ. But the agency was unable to capitalize on the deal because DMX couldn't stay out of court.

In August, DMX -- whose real name is Earl Simmons -- was arrested for reckless driving, and he's currently involved in two child support disputes. Because one of those disputes involves over $1 million in unpaid support, TMZ reports that a lien has been placed on DMX's passport, which means he can't go abroad.

The DMX tour lawsuit asserts that the booking agency paid off a number of these debts so the court would allow DMX to travel overseas. When the court refused, Heavy Rotation claims DMX went and hired another company that tried to book U.S. tour dates. This allegedly violated DMX's initial agreement with Heavy Rotation.

From the sound of things, Heavy Rotation has a decent chance of winning the DMX tour lawsuit. Every contract has an implied covenant of good faith and fair dealing. This is a promise not to do anything to interfere with the other party's rights under the contract. It seems DMX consistently interfered with the agreement even after the agency tried to fix his problems.
