It’s a two-in-one day for Lindsay Lohan! LiLo just can’t stay out of legal trouble, can she?
Today, Lohan’s in the news for tax evasion (again). Oh, and her lawyer is trying to find another creative argument to get her out of her lying-to-the-cops case from last year.
But first, since it’s the right time of year to talk about taxes, let’s talk about state versus federal taxes. Yes, there are two authorities that many citizens have to pay taxes to. At least in California, where Lohan lives.
So, it seems as though she may have thought she was free and clear after she dealt with her IRS tax issues in December. At that time, the IRS seized Lohan’s bank accounts, until Charlie Sheen rode in on his white horse and saved the day with a $100,000 check.
But those were federal taxes. And the new problem relates to state taxes. Lohan allegedly owes $56,717.90 in state taxes to California for 2011.
Now, moving on to other LiLo news, her attorney has now raised the Miranda issue regarding a pending case. You might remember that Lohan told cops that she was not driving the Porsche when she got into an accident on the Pacific Coast Highway last year, as reported by TMZ. This was taken as a lie and as a result, police wrote her up. The problem for Lohan was that she was already on probation for her shoplifting case so this alleged lie could be seen as a probation violation.
Now, Mark Heller, her attorney, has filed a motion seeking to dismiss Lohan’s case, claiming that she was never read her Miranda rights.
Is he way out of line on this argument? Was there even a need to give Lohan any Miranda warnings when she was stopped? It’s not abnormal or illegal for there to be no Miranda warnings in ordinary car accidents.
Miranda rights apply when a person is in custody, namely, when they’re no longer free to leave. Under the Miranda rules, police must issue a Miranda warning, which is the standard jargon you’ll hear on any cop show (i.e. “You have the right to remain silent, you have the right to speak to an attorney).
