Ex-Porn Star Jenna Jameson Busted for Battery

Ex-porn star Jenna Jameson was arrested and charged with battery after allegedly attacking someone over the weekend.

Police in Newport Beach, California, offered few details about the alleged attack, aside from stating that the victim made a citizen's arrest of the actress, reports CNN. The victim and Jameson were acquaintances, though it's unclear the exact nature of their relationship.

Jameson, 38, was taken to a jail in Orange County, but she was released without having to post bail. She faces a misdemeanor charge for the battery.

While police have not divulged much, Jameson has taken to Twitter to tell her side of the story. She posted that she was robbed by a friend who broke into her home and took everything, reports CNN.

If what Jameson tweets is true, she may have a viable defense to the battery charges. She could claim that she attacked the victim because she was protecting her home and property.

Many states permit someone to act in self-defense to protect both their person as well as their property, like their home. For example, if someone threatens to burn down your home or otherwise cause damage to it, you could presumably use self-defense to protect your home.

Furthermore, you may also arguably use physical force to remove a trespasser in your home who refuses to leave.

The amount of force that someone may use in defense of property generally is limited to a "reasonable" amount. So you probably cannot shoot someone who threatens to break a window, though you can use enough force to prevent the act.

So if the victim of the alleged battery threatened Jenna Jameson's home or property, or was in the midst of committing a burglary, then the former porn star may have been justified in using physical force against the alleged victim.
