  • Juvenile Miranda Rights: Police Must Consider Age: FindLaw's Decided breaks down how the Supreme Court, which as recently as last year was chipping away at Miranda protections, ruled on Thursday in favor of a more expansive approach to juvenile Miranda rights. Citing common sense and the unique vulnerability attributable to children, the Court's decision directs law enforcement to consider a juvenile's age when determining whether or not they must give him his Miranda warnings prior to questioning.

  • Are Warrantless Cell Phone Searches Legal?: FindLaw's Blotter notes that state and federal courts are divided on the issue of warrantless cell phone searches. Courts in California, Florida and Georgia have ruled warrantless cell phone searches are justified under the "search incident to a lawful arrest" exception to the 4th Amendment's warrant requirement. Because the Supreme Court has not ruled on the issue of warrantless cell phone searches, there is still a lot of confusion amongst courts and civil rights advocates.
