A DUI is about what state you're in, not necessarily what substance you're on. And by that we mean DUI charges aren't limited to driving under the influence of alcohol, or just the influence of drugs. A perfectly innocent substance (although one meant for external use, not internal consumption) get you a DUI just as easy an illicit one.
We've all been there -- cruising around with your buddy, bouncing your car off street signs, parked cars, and police cruisers, all while switching seats in between accidents. Were the swapped seats an effort to throw the cops off their scent? Or an attempt to settle, for good this time, who was more drunk? We may never know.

This is a strange one we're still trying to sort out. So far, no autonomous automobile or its driver/passenger has been cited for drunk driving. But the way car companies are treating accidents and the way DUI statutes are enforced, you're likely on the hook, even if your hands aren't on the wheel.
