Jon Gosselin Plans to File Countersuit against TLC

It seems that TLC has feisty one on their hands! Jon Gosselin isn't willing to go down without a fight over their breach of contract lawsuit. According to NY Daily News, Jon Gosselin plans file a countersuit against the network for a cool $5 million dollars.

The grounds for Jon Gosselin's countersuit are that he feels that TLC took advantage of him when he signed the contract with the network since he was not adequately represented at the time.

We wrote about TLC's warning against Jon Gosselin here. Initially, TLC informed Gosselin that he was violating the morals clause of the his contract with TLC through his affairs, erratic behavior, and possible mismanagement of family finances.

This warning then led to the TLC v. Jon Gosselin lawsuit which we covered here. The lawsuit was filed by TLC in the Circuit Court in Maryland. The claims brought against Gosselin are: granting unauthorized interviews which violated Jon Gosselin's contract with TLC and non-cooperation on Gosselin's part for filming the show.

What is a contract?

A contract is a legally enforceable agreement between two or more parties that creates an obligation to do or not do particular things. The term "party" can mean an individual person, company, or corporation. No matter who the parties are, contracts almost always contain the following essential elements:

  • Parties who are competent to enter into a contract 
  • Mutual agreement by all the parties; i.e., all parties have a meeting of the minds on a specific subject. 

Jon Gosselin may feel that he did not mutually agree with the contract. If he felt he was not adequately represented, this is a possibility.

Gosselin must appear in court December 14. He plans to countersue TLC then. There is one major snag for this particular dad of the year. According to their website, his lawyers Mike and Mark Heller are not licensed to practice law in the state of Maryland and Jon Gosselin has failed to file paperwork naming his representation.
