Yoga pants are apparently officially pants these days, but if you're wearing one of the most popular pairs of yoga pant-like leggings on the market, you might not be wearing much at all. A new lawsuit claims legging brand LuLaRoe knew their soft products were shoddy, and sold them anyway.
The lawsuit claims customers complained that "holes, tears, and rips appear before wearing, during the first use or shortly thereafter" in the pants, which were also described as "tearing as easily as 'wet toilet paper.'"
For those unfamiliar, LuLaRoe is a multi-level marketing company who uses independent sales consultants to sell its products on social media. While the company also sells shirts, dresses, and other clothing, LuLaRoe's leggings are its signature product.
Which can be a problem if that product is defective. Not only did customers complain about the leggings falling apart quickly after purchase, but they often didn't fit properly either. Customers noted that one leg would be substantially larger or smaller than the other, and supposedly adult-sized leggings were "too small as if they were manufactured for a child."
The most damning allegation regarding the leggings is that LuLaRoe knew they were defective and yet did nothing. The lawsuit points to a company-wide email from Patrick Winget, LuLaRoe's head of production, in which he admitted "the leggings may get holes, because we weaken the fibers to make them buttery soft. We have done all we can to fix them."
The plaintiffs claim that LuLaRoe therefore chose "to sacrifice the quality of their products in order to meet the growing demand at the expense of customers. The extent to which they have done this, however, is unacceptable."
Whether a judge will be swayed by that argument, remains to be seen, but we do know what both sides should not wear to court.
