Summary Judgment for Defendant in Political Whistleblowing Case

In Bonn v. City of Omaha, No. 09-3332, an action claiming that plaintiff was wrongfully terminated from her position as the Public Safety Auditor for the City of Omaha after she published a report criticizing the Omaha Police Department, the court affirmed summary judgment for defendants where the evidence did not support a finding that plaintiff reasonably believed that she opposed an unlawful employment practice by publishing her report.

As the court wrote:  "Tristan Bonn was terminated from her position as the Public Safety Auditor for the City of Omaha after she published a report criticizing the Omaha Police Department ("OPD"). Bonn filed suit in Nebraska state court against the City of Omaha, former Mayor Mike Fahey, and the former Mayor's Chief of Staff Paul Landow (collectively, "appellees"). Bonn asserted a claim under Title VII of the Civil Rights Act, 42 U.S.C. § 2000e et seq., alleging that the appellees unlawfully retaliated against her for opposing discriminatory employment practices."
