Block on Trump's Asylum Ban Upheld by Supreme Court
Back in April, Legally Weird reported on Michael Kevin Lallana, a California man convicted of ejaculating into a water bottle left on his female co-worker's desk.
The judge in that case has now ordered Lallana to pay his victim $27,400 in restitution, covering lost wages, therapy, medical expenses, as well as money expended in having the foul-tasting water tested.
She needs to file a civil suit.
Motivated by sexual gratification, Lallana twice ejaculated into a water bottle, leaving them on the desk of the woman so that she could later drink their contents.
Despite arguing that he has a narcissistic personality disorder, the Orange County Register reports that the jury convicted him of two counts of battery.
He was sentenced to six months in jail, three years probation, and told to register as a sex offender.
Orders of restitution are not that uncommon of a punishment in criminal court, but because they are limited to a victim's actual expenses, it's not surprising that Lallana's behavior only warranted an award of $27,400.
If the woman wants to recover more, she will need to file a civil lawsuit, alleging that she was the victim of civil battery and assault, as well as intentional infliction of emotional distress.
Using the conviction as proof of the incident, she will likely be able to recover non-economic damages, such as pain and suffering, and potentially punitive damages, particularly in light of the horrendous nature of his acts.
So, in reality, $27,400 is not the price Michael Kevin Lallana must pay for ejaculating into a water bottle. At least not if his victim doesn't want it to be.
