Equal Employment Opportunity Comm'n v. Autozone, Inc., 10-1353, concerned a challenge to the district court's grant of summary judgment on a failure-to-accommodate claim, in the Equal Employment Opportunity Commission's (EEOC) suit on behalf of defendant's former employee under the Americans with Disabilities Act.
In reversing the judgment, the court remanded the matter in concluding
that the evidence the EEOC has presented is plainly susceptible to the
determination that the employee had a disability within the meaning
intended by the ADA as required to prove a failure to accommodate, and
as such, summary judgment should not have been granted on that basis
that the employee was not disabled.
